Estate Planning, Administration & Litigation Attorney

We are seeking a dynamic and highly experienced Senior Counsel specializing in Estate Administration and Estate Litigation to join our dynamic team and contribute to the continued success of the firm. What We’re Looking For

Our ideal Senior Counsel candidate will have 10+ years of experience in high net worth estate administration, planning and litigation, providing guidance to fiduciaries and beneficiaries throughout the probate process, including filing petitions, identifying assets, settling debts, making court appearances and preparing/reviewing accountings. Experience in representing clients in complex legal disputes arising from Wills, and Trusts and Estates including litigating matters in court. Strong negotiating skills are required as well as experience advocating for clients in matters related to inheritance disputes, distribution of assets and contested probate proceedings.

We value a candidate with exceptional client interaction skills , the ability to manage a diverse caseload, and leadership experience in managing paralegals and supporting teams. A passion for client acquisition and business development is also a strong asset.

Key Responsibilities:

  • Lead the administration of complex estates, including probate and non-probate assets, trust administration, and post-death planning.
  • Represent clients in contested estate matters, including will contests, trust disputes, fiduciary disputes, and allegations of undue influence or lack of capacity.
  • Provide strategic guidance and advice on complex estate litigation issues, including dispute resolution and settlement negotiations.
  • Advise fiduciaries, including executors, trustees, and personal representatives, on their rights, responsibilities, and potential risks during the estate administration process.
  • Conduct probate proceedings and litigation in Surrogate's Court, including motions, hearings, and trials.
  • Collaborate with clients, experts, and other professionals (such as accountants and appraisers) to gather necessary information and resolve disputes.
  • Effectively manage multiple cases simultaneously, ensuring all deadlines are met and that clients’ needs are addressed in a timely and efficient manner.
  • Mentor and provide guidance to junior attorneys, paralegals, and support staff involved in estate administration and litigation matters.
  • Build and maintain strong relationships with clients, offering personalized and empathetic legal support in emotionally sensitive matters.
  • Stay updated on changes in the law to provide clients with informed and cutting-edge legal advice.
  • Participate in firm marketing efforts to expand the estate administration and litigation practice, including developing content and building client relationships.

Qualifications:

  • Juris Doctor (JD) degree from an accredited law school.
  • Active and valid license to practice law in New York.
  • Minimum of 10+ years of experience in estate administration and estate litigation, and related areas of elder law.
  • Strong experience in probate court procedures, estate litigation, will contests, and fiduciary disputes.
  • Proven ability to handle complex litigation cases from inception to resolution, including trial experience.
  • Excellent legal research, writing, and drafting skills, particularly in the areas of estate administration and estate litigation.
  • Ability to effectively negotiate settlements and resolve disputes in a timely and cost-effective manner.
  • Strong communication and client service skills, with an ability to explain complex legal matters to clients in an approachable manner.
  • Ability to work independently and as part of a collaborative team.
  • High level of professionalism, discretion, and sensitivity in dealing with clients and their families.
  • Compassionate and empathetic approach to client service with the ability to handle sensitive situations.
  • Strong team player with leadership capabilities and a collaborative work style.
